Introduction

OpenWaterRx ("Company," "we," "us," or "our") owns and operates this website and related services (the "Site" and "Services"). By accessing or using the Site or Services, you agree to be bound by these Terms of Use.

If you do not agree, do not use the Site.

Nature of Services

OpenWaterRx does not provide medical care.

We provide administrative and technology services that connect you with independent licensed medical providers ("Providers") affiliated with third-party medical groups.

  • Providers are independent professionals
  • Providers are solely responsible for your care
  • Use of this Site does not guarantee treatment or prescriptions

No Provider-Patient Relationship

Using this Site alone does not establish a provider-patient relationship.

A relationship is only formed if:

  • A licensed Provider accepts your case
  • You complete required intake and consent

Providers may determine telehealth is not appropriate and require in-person care.

Independent Medical Judgment

All clinical decisions are made by Providers using independent medical judgment.

OpenWaterRx:

  • Does not control treatment decisions
  • Does not guarantee prescriptions
  • Is not responsible for medical outcomes

Pharmacy Services

OpenWaterRx is not a pharmacy.

If prescribed, medications are fulfilled by licensed third-party pharmacies, which operate independently.

You may enter into a separate relationship with the pharmacy.

Services are currently offered in all 50 states and Washington D.C.

Some services may not be available in all locations. Availability is subject to change.

Compounded Medications

Some prescribed medications may be compounded.

  • Compounded medications are not approved finished drug products
  • They are prepared by licensed pharmacies
  • Risks and alternatives are discussed with your Provider

Eligibility

You must:

  • Be at least 18 years old
  • Provide accurate and complete information
  • Be legally able to consent to care

Payments & Subscriptions

You agree to pay all fees presented at checkout.

  • Pricing may change at any time
  • Some services may be subscription-based
  • Subscriptions auto-renew unless canceled

OpenWaterRx may collect payments on behalf of Providers and pharmacies.

Cancellation & Refund Policy

  • You may cancel subscriptions at any time
  • Access continues through the current billing period
  • Medical services and fulfilled prescriptions are non-refundable
  • No refunds once medication has been processed or shipped

Electronic Communications

You consent to receive communications electronically, including:

  • Emails
  • SMS/text messages
  • Platform notifications

Privacy & Health Information

We collect and share information to facilitate care, including:

  • Medical history
  • Personal information
  • Prescription data

Information may be shared with:

  • Providers
  • Medical groups
  • Pharmacies
  • Labs

Use of your data is governed by our Privacy Policy.

Prohibited Use

You may not:

  • Use the Site unlawfully
  • Provide false information
  • Attempt to access systems improperly
  • Interfere with Site functionality
